This website (the “Website”) is operated by Itty Bitty S.A.L. (“Itty Bitty”), a joint stock company organized and existing under the laws of Lebanon and registered at the Beirut Commercial Register under number /1030161/.

By accessing and placing an order with Itty Bitty, you agree to be bound by the terms of service outlined herein below. These terms apply to the Website as well as to any type of correspondence between you and Itty Bitty. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our site. It is your responsibility to check this page periodically for changes.

Itty Bitty purchases and sells second hand clothes and accessories for babies and kids. We aim to always describe the condition, color and pattern of the items as correctly as possible. We will outline any significant imperfections, tear and wear. We closely examine all pieces in our selection process so as to prevent sales of any counterfeited items. The Parties selling their secondhand clothes and accessories through Itty Bitty are liable to ensure their respective authenticity.

To the fullest extent permitted by law, in no event will Itty Bitty, its officers, shareholders, employees, agents, directors, subsidiaries, affiliates, successors, assigns, suppliers, or licensors be liable for (1) any indirect, special, incidental, punitive, exemplary, or consequential damages; (2) any loss of use, data, business, or profits (whether direct or indirect), in all cases arising out of the use or inability to use the items proposed on the Website. If your use of materials results in the need for servicing, repair or correction, you assume any costs in connection thereof.

We reserve the rights to discretionary and solely amend the present Terms and Website usage conditions, including any pricing strategy and policy, at any moment.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to propose our products and services.

The Service is available only as a paid service. You are billed upon placement of a purchase order.

Prices for our products are subject to change without notice.

We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

Clothes and items are delivered by our clients on a consignment basis. We only accept goods that are in unused, excellent or good condition. You are solely responsible to guarantee the authenticity of all goods you sell to us on a consignment basis. We do not accept counterfeit goods. If the items do not meet the above requirements, they will not be accepted and will be either (1) returned to you at your expense or (2) with your approval, confirmed in writing, Itty Bitty will donate them to a charity organization of its choice. We will control the items within ten (10) business days. Once we have received, controlled and accepted the items, we will sell them on a best effort basis with no commitment from our part.

As a potential seller of the consigned products, you warrant to us that:

• You own the Product, and you have the legal right, title and interest to sell it;
• The Product is authentic and not counterfeit;
• The sale of the Product does not violate any law or regulation;
• The Product is in a clean and hygienic condition, and free from infestations;
• Neither the Product nor its sale infringe any third party’s rights.

We will do our utmost to ensure that our Services will be uninterrupted, and that the transmission will be error-free. However, due to the nature of the internet connection and the internet service, this cannot be guaranteed.

In the event a Service is listed at an incorrect price due to typographical error or error in pricing information, we reserve the right to refuse or cancel any orders placed for a service listed at the incorrect price, whether or not the order has been confirmed and your bank card charged. If your credit card has already been charged for the purchase and your order is canceled, we will issue a credit to your bank card account in the amount of the incorrect price, within a reasonable time.

Itty Bitty may take photos, videos, or images of the Products at any point, including without limitation when the Products are being picked up from a potential seller’s premises or delivered to a buyer’s premises. You hereby grant Itty Bitty a perpetual, irrevocable, world-wide, royalty-free, full paid-up right to display, distribute, and otherwise use such materials in connection with Itty Bitty’s business purposes.

You agree not to, and you will not permit others to:

• License, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose, or otherwise commercially exploit the Website or make the platform available to any third party.
• Modify, make derivative works of, disassemble, decrypt, reverse compile, or reverse engineer any part of the Website.
• Remove, alter, or obscure any proprietary notice (including any notice of copyright or trademark) of Itty Bitty or its affiliates, partners, suppliers, or the licensors of the Website.
• Reproduce, duplicate, copy, sell, resell or exploit any portion of the Product or Service, use of the Service, or access to the Service or any contact on the Website through which the Service is provided, without express written permission by us.

Without limiting the foregoing, neither Itty Bitty nor any Itty Bitty's provider makes any representation or warranty of any kind, express or implied: (i) as to the operation or availability of the Website, or the information, content, and materials or products included thereon; (ii) that the Website will be uninterrupted or error-free; (iii) as to the accuracy, reliability, or currency of any information or content provided through the Website; or (iv) that the Website, its servers, the content, or e-mails sent from or on behalf of Itty Bitty are free of viruses, scripts, trojan horses, worms, malware, timebombs or other harmful components.

We will not have any liability if we are prevented from performing any of our obligations on account of any circumstances beyond our reasonable control including, but not limited to, fire, flood, act of God, riots, pandemic, terrorism, war, strikes, and restrictions of any government or difficulty in obtaining materials and/or labour issues. In any of these circumstances we reserve the right to delay, cancel or, at our discretion, any of the orders.

Except as provided herein, the failure to exercise a right or to require performance of an obligation under this Agreement shall not affect a party's ability to exercise such right or require such performance at any time thereafter nor shall be the waiver of a breach constitute waiver of any subsequent breach.

Save any other agreement executed for a specific arrangement with Itty Bitty (for instance, the agreement under which the Products are consigned), this Terms of Service constitutes the entire agreement between us regarding our Service and the Website use.

You may be subject to additional terms of service that apply when you use or purchase other Itty Bitty's services, which Itty Bitty will provide you at the time of such use or purchase.
